I get the feeling that Democrats are more convinced that the Supremes are going to find all or part of ObamaCare unconstitutional than I am. The excuse making has begin already. This morning I was treated by a “Democrat strategist” named Chuck Rocha on Fox & Friends. Rocha is a long-time union type … so you can just guess where he stands. He’s one of the “health care is a right” crowd. So this Rocha character was saying that if ObamaCare is overturned by the Supreme Court it will be a purely political decision. Why? Because 58% of Constitutional Law professors say that the mandate is constitutional. Huh? I can guarantee you that the vast majority of Constitutional Law professors would tell you that our Constitution grants a right to vote. These are professional academics … if they really knew what they’re talking about they would be out there in private practice.
Anyway … let’s check in with Rocha to see just how much HE knows about our Constitution. He told the F&F crowd that “I don’t think that this Supreme Court has the best record of standing with the American people.” Now just how many of you see right through this asinine argument right from the start. It is not the ROLE of the Supreme Court to stand by the people. That’s the purpose of the House of Representatives. (The Senate was originally set up to stand by the States – but the 17th Amendment screwed that one up.) The Supreme Court’s role is to stand by the CONSTITUTION. A good Republican “strategist” would know that.
